By purchasing access to the tutorial materials from Peak Psychology Inc (www.TradingPsychologyEdge.com), including training classes, seminars, webinars, video and audio recordings and all supporting documents, I (customer) accept the following terms of agreement and disclaimer:
I (customer) acknowledge and agree that the tutorial materials I am purchasing contain protected intellectual property, particularly with respect to the use, combinations and applications of the tutorial materials. The tutorial materials are Copyright © 2009-2015 Gary Dayton and Peak Psychology, Inc. and are protected by the copyright laws of the United States of America and reciprocal laws of the international community. I (customer) acknowledge this and I agree and pledge never to convey, distribute, copy, teach, or post on the worldwide web, including forums and public trading sites, nor to barter, sell, exchange, reveal or disseminate in any way the information you (Peak Psychology Inc & TradingPsychologyEdge.com) provide to me, including examples applying the tutorial materials, unless you (Peak Psychology Inc & TradingPsychologyEdge.com) specifically consent in writing. I pledge that your tutorial materials are safe with me and are purchased for my personal use and study only.
I (customer) further acknowledge that no promise, representation, assurance or warranty has been made or given in relation to the profitability or benefits to be obtained from the use and application of the tutorial materials. I understand that hypothetical, hindsight and simulated performance results have inherent limitations and do not represent actual trading. I agree that the examples discussed and presented in the tutorial materials are for educational purposes only. I acknowledge that trading is a highly risky activity in which substantial financial losses can and do occur and that there is considerable and extensive knowledge, skills, abilities and experience required for competent trading beyond what is provided in the tutorial materials.
I (customer) acknowledge that I am responsible for my own trading actions and I expressly agree to hold Gary Dayton, President of Peak Psychology, Inc, Peak Psychology Inc., TradingPsychologyEdge.com and all affiliates harmless from my use of the tutorial materials and from my trading results. I expressly agree that Gary Dayton, President of Peak Psychology, Inc, Peak Psychology Inc., TradingPsychologyEdge.com and all affiliates shall not be liable for damages arising out of my use of the tutorial materials. I also acknowledge that it is prudent for me to consult a certified financial advisor before making any trading or investment decisions.
I (customer) also understand that Gary Dayton, President of Peak Psychology, Inc., Peak Psychology Inc. and/or TradingPsychologyEdge.com are explicitly not providing therapeutic treatment services or clinical psychological treatment services. I acknowledge that mental skills tutorial materials and psychological education materials are for educational purposes only and for trading performance development only. I understand and acknowledge that mental skills tutorials and psychological educational materials are not designed to or are to be used to address psychological or mental disorders or difficulties I may have or may experience. I understand and agree that mental skills tutorials and psychological educational materials are not to be used for clinical or therapeutic purposes. If I suspect or believe that I may have or be suffering from a mental illness, psychological disorder or psychological problem that is affecting my life, I understand that it is my responsibility to seek professional help from a qualified mental health practitioner in my area.
I (customer) further agree that in the event Gary Dayton, President of Peak Psychology, Inc., Peak Psychology Inc. and/or TradingPsychologyEdge.com bring legal action against me as a result of my violation of the terms of this agreement, I do hereby agree to pay the costs of such action, including all reasonable legal fees, should it be determined I have breached this agreement.
I (customer) also understand there will be no refunds for the tutorial materials I purchase.
